What Is Spartan Pay?
1.1 Spartan Pay is a lay-by / instalment payment option offered by Spartan AUS 3.0 Pty Ltd (“Spartan”, “we”, “us”, “our”) that allows eligible participants to pay for certain race passes or event entries by instalments.
1.2 Spartan Pay:
*is not a credit product;
*does not involve interest, fees or finance charges (other than the reinstatement fees set out below); and
*does not involve the provision of credit by Spartan.
1.3 These Spartan Pay Terms apply in addition to Spartan’s standard event Terms and Conditions. To the extent of any inconsistency:
(a) these Spartan Pay Terms will prevail in relation to payment plans, instalments, cancellations of Spartan Pay plans, credits, fees and related matters; and
(b) Spartan’s standard event Terms and Conditions will prevail in relation to event participation, waivers, safety, conduct, scheduling and general event operations.
Eligible Products
2.1 Spartan Pay is available only for:
*selected Spartan passes (including Trifecta-type passes and similar products);
*selected endurance-format passes;
*selected Tough Mudder or Highlander Adventure passes (including multi-day formats); and
*single event entries where the purchase price exceeds a minimum threshold determined by Spartan from time to time.
2.2 Spartan Pay is not available for:
*merchandise;
*add-ons or ancillary products;
*team, corporate, sponsor, complimentary or deferred entries; or
*any other products excluded by Spartan at its discretion.
2.3 Spartan may limit the availability of Spartan Pay to certain periods of the year. All instalments must be paid in full before the event or events to which the pass or entry relates.
Eligibility
3.1 Spartan Pay is available to individual participants only.
3.2 Spartan Pay is not transferable. You may not assign, transfer or novate your Spartan Pay obligations to another person.
3.3 Spartan reserves the right to restrict or refuse Spartan Pay where required to comply with applicable laws or regulatory obligations in relevant jurisdictions.
Pricing and Instalments
4.1 The total price payable under Spartan Pay is locked in at the time of the first instalment payment, provided instalments are paid in accordance with the agreed payment schedule.
4.2 The total amount payable will be displayed at checkout and includes all applicable taxes.
4.3 For single-event tickets (single race or combo race formats inc. Trifectas), instalment amounts and due dates will be disclosed prior to purchase. Unless otherwise stated:
30% is payable at checkout;
*35% is payable 60 days prior to the relevant event; and
*the balance is payable 30 days prior to the relevant event.
For season passes, instalment amounts and due dates will be disclosed prior to purchase and must be paid strictly in accordance with the instalment schedule.
4.4 Spartan Pay purchases are not eligible for:
*promotional codes;
*loyalty discounts; or
*retrospective price adjustments.
- Payment Method and Authorisation
5.1 Spartan Pay is available only via automatic debit using a valid payment method approved by Spartan.
5.2 By selecting Spartan Pay, you authorise Spartan to: store your payment details securely; and automatically debit each instalment on or after the scheduled due dates.
5.3 It is the participant’s responsibility to ensure a valid payment method remains on file, with sufficient funds or credit available, at all times until all instalments are paid in full.
5.4 Participants are responsible for keeping their contact details current so Spartan can send payment reminders, failed payment notices and other account communications.
- Payment Failure, Reinstatement and Cancellation
6.1 A payment will be treated as failed if it is declined after up to three retry attempts made within a reasonable period determined by Spartan’s payment system.
6.2 Spartan will endeavour to notify you of a failed payment via email and/or SMS. Spartan may also send payment reminders, failed payment notices or instalment communications by email and/or SMS.
6.3 If an instalment remains unpaid for more than 7 days after the due date, Spartan may suspend the participant’s Spartan Pay plan and, following reasonable reminder attempts and internal review, may cancel the registration or Spartan Pay plan. Where practicable, Spartan will provide notice of cancellation by email and/or SMS.
6.4 If your Spartan Pay plan is cancelled due to non-payment, you may apply for reinstatement within 14 days of the payment failure.
Reinstatement may also require payment of any increase between the original Spartan Pay price and the prevailing retail price at the time of reinstatement, where instalments were not paid when due. Reinstatement is subject to:
successful payment of all overdue instalments; and
*payment of a $50 reinstatement fee.
6.5 Spartan is under no obligation to reinstate a cancelled Spartan Pay plan.
7. Use of Passes and Event Participation
7.1 You may register for races or events covered by your Spartan Pay purchase prior to completing all instalments.
7.2 Once you have registered for a race or event, that race or event is considered used for the purposes of Spartan Pay (including for Section 8), regardless of whether you ultimately participate.
7.3 You acknowledge that Spartan Pay allows you to access discounted or locked-in pricing in exchange for committing to the full instalment schedule.
7.4 Full payment must be received before participation in any event. Spartan may withhold final heat allocation, bib issue, check-in or participation until all outstanding amounts are paid.
7.5 If there is an obvious mismatch between the Spartan Pay product purchased and the race, category or ticket selected, Spartan may correct the registration or contact the participant to resolve the issue. Spartan will act reasonably and, where practicable, provide notice of any adjustment.
- Over-Use of Races and Reimbursement
8.1 Spartan Pay allows you to register for and access races or events before all instalments have been paid in full.
8.2 If the total prevailing retail value of races or events you have registered for or participated in exceeds the total amount you have paid under your Spartan Pay plan, and you then fail to complete the remaining instalments, Spartan may cancel your Spartan Pay plan and require you to reimburse the value of those races or events.
Registration for a race or event constitutes use of that race or event for the purposes of this clause, whether or not you ultimately attend or participate.
8.3 Any reimbursement required under this clause:
*will be calculated using the standard retail price applicable to each race or event on the date the race or event occurred;
*will be credited by any amounts already paid under your Spartan Pay plan; and
*will not exceed the total retail value of the races or events you have registered for or participated in.
8.4 This reimbursement reflects the value of services already provided by Spartan and is not a penalty.
8.5 If reimbursement is required and not paid within a reasonable period, Spartan may:
*restrict your eligibility to use Spartan Pay in the future; and
*pursue recovery of the outstanding amount in accordance with applicable law.
- Refunds and Credits
9.1 If your Spartan Pay plan is cancelled for non-payment or at your request, Spartan may apply amounts paid by you in the following order:
*first, to the full prevailing retail price of any races or events used;
*second, to any applicable administrative fees; and
*third, any remaining balance may be issued as race credit, except where refund is required by applicable law or expressly agreed by Spartan.
9.2 The initial deposit may be retained and applied toward reasonable administrative, pricing-lock, booking and capacity reservation costs associated with offering, establishing and managing a Spartan Pay plan, except where otherwise required by applicable law.
9.3 Any race credit issued under this clause:
will be valid for 12 months from date of issue unless otherwise stated;
*is subject to Spartan’s standard event terms; and
*is not redeemable for cash except where required by law.
9.4 Refunds, if any, will be processed to the original payment method unless otherwise required by law.
- Spartan-Initiated Cancellation
10.1 Spartan may cancel your Spartan Pay plan immediately if we reasonably believe you have engaged in
*fraud;
*breach of these Terms;
*system abuse; or
*misuse of Spartan Pay.
10.2 In such cases, Spartan may cancel the plan without refund, to the extent permitted by applicable law.
- Deferrals, Event Changes and Force Majeure
11.1 Standard Spartan event terms relating to deferrals, cancellations, postponements and force majeure, including any applicable refund, transfer or credit rights under those terms, apply to races or events purchased using Spartan Pay.
11.2 Spartan Pay does not create any additional rights beyond those set out in the applicable event terms.
11.3 If a participant elects to cancel their Spartan Pay plan, Clause 9 applies. Any remaining balance after applicable deductions will be dealt with in accordance with Clause 9.
11.4 Withdrawal from a race or event purchased using Spartan Pay remains subject to Spartan’s standard withdrawal, transfer and refund policies. Participation via Spartan Pay does not create any additional refund rights.
11.5 Entries purchased using Spartan Pay may only be transferred to another eligible participant or event once all instalments have been paid in full and subject to Spartan’s standard transfer terms, availability and any applicable fees. Partial payments and Spartan Pay plans themselves are not transferable.
11.6 Once fully paid, participants may request an upgrade to another eligible event or category, subject to availability and payment of any applicable price difference at the prevailing rate.
11.7 Requests to downgrade to a lower-priced event, category or product may be considered by Spartan acting reasonably and subject to operational feasibility. Unless otherwise required by law, no refund, credit or price adjustment is guaranteed, and an administration fee may apply.
- Consumer Law
12.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies you may have under the Australian Consumer Law or other applicable legislation that cannot lawfully be excluded.
12.2 Where permitted by law, Spartan’s liability is limited to the resupply of the services or a refund of the amount paid.
- Changes to Spartan Pay
13.1 Spartan may modify or withdraw Spartan Pay at any time. Changes will not affect Spartan Pay plans already entered into.
- Governing Law
14.1 These Terms are governed by the laws of Victoria, Australia, and the courts of Victoria have exclusive jurisdiction.
